Workplace Misconduct Investigations

WHEN THE STAKES ARE HIGH

Independent support for complex workplace matters.

Allegations involving senior leaders, multiple parties, financial irregularities or significant safety concerns can place considerable pressure on an organisation. An external investigator provides separation from internal relationships and a structured process for establishing the facts.

Synergy’s investigation experience includes fraud and theft allegations, workplace safety breaches, intoxication at work, conduct outside work and abuse complaints within care organisations. We assess each matter on its evidence and agreed scope.

THE FIRST RESPONSE

Act promptly.
Preserve your options.

Address immediate safety concerns, preserve potentially relevant evidence and identify who will manage the workplace while the investigation proceeds. Avoid reaching conclusions before the allegations have been tested.

Where a matter may involve criminal conduct or reporting obligations, obtain appropriate advice early. A workplace investigation does not replace police or regulator processes.

Before interviews begin

  • Clarify the allegations: identify the specific conduct, dates, people and relevant policies.
  • Assess workplace risk: consider risks to workers, vulnerable people, records and assets.
  • Preserve evidence: identify emails, financial records, access logs, CCTV and other relevant material.
  • Plan communication: assign clear contacts, explain confidentiality limits and consider participant support.

HOW WE WORK

How a serious misconduct investigation works

The scope is tailored to the allegations, available evidence and complexity of the matter.

01

Scope and plan

Clarify the allegations, terms of reference, relevant policies and reporting arrangements. Check independence and potential conflicts.

02

Listen and gather

Identify relevant records and interview participants. Preserve context and distinguish first-hand knowledge from assumption or hearsay.

03

Test the evidence

Assess corroboration, inconsistencies and competing explanations. Give the respondent an opportunity to answer allegations and relevant adverse material.

04

Report the findings

Set out the evidence, reasoning and findings for each allegation within scope. The organisation decides subsequent action with its advisers.

Matters we can help investigate

The nature, seriousness and context of the alleged conduct determine the investigation scope. A label alone does not establish misconduct.

YOUR QUESTIONS

Before you engage an investigator

What is serious misconduct?

Fair Work Regulation 1.07 covers deliberate conduct incompatible with continued employment and conduct creating serious and imminent risks to safety or the employer’s business. Examples include theft, fraud and assault. Whether particular conduct meets the definition depends on the circumstances. See the Fair Work Commission’s conduct guidance.

What standard of proof applies?

Workplace findings generally use the balance of probabilities: whether the conduct more likely than not occurred. Serious allegations require careful attention to the strength and quality of the evidence; they do not automatically change the standard to proof beyond reasonable doubt.

Can conduct outside work be investigated?

There needs to be a relevant connection to employment. Private conduct is not automatically a workplace matter. Obtain advice on that connection and the proposed scope before commencing an investigation.

Does a finding of serious misconduct mean immediate dismissal?

No automatic outcome should be assumed. The investigation establishes findings; the employer separately considers any employment response, the circumstances and applicable obligations with appropriate advice.

What if police or a regulator are involved?

Raise any existing or potential external process at the outset. Seek legal advice about reporting duties, evidence preservation and the timing and scope of workplace enquiries. A workplace investigator does not determine criminal guilt.

How long will it take, and what will it cost?

The number of allegations, participants, records and any external processes will affect timing and cost. An initial discussion helps define the scope, estimate the work and agree on progress updates.

HOW THE PROCESS CAN WORK

An undisclosed supplier connection

Illustrative example—not an actual client matter.

The concern

A finance team identifies payments to a supplier linked to an employee. The employee says the relationship was disclosed verbally and that the purchases were legitimate.

Evidence to explore

The enquiry could examine procurement policies, declarations, invoices, approval records, emails and witness accounts. The investigator would test both the concern and the employee’s explanation, including whether relevant records support either account.

A reasoned response

The report would distinguish established facts from unresolved questions and explain its reasoning for each allegation. The organisation would decide what action follows and whether its procurement or disclosure processes need attention.
